Herein below is a YouTube video from the Santa Fe Elementary School’s Peace March that was done for the Aaron & Margaret Wallace Foundationthat you can take a look at in it’s rough form. We want to do several of these for the sponsors, including SemiFreddis, Trader Joe’s, Little Caesar’s Pizza, among others.
The day long program began at 9:00 am with a free community breakfast. After breakfast there was a rally, then a march through the neighborhood culminating in a gathering at the school. There were corporate, food and vendor booths with lots of fun things for the children and adults alike at the school yard. The event had the support of Santa Fe Elementary Alumnus, ALL-Americans, NFL All-Pro, NBA World Champions, North Oakland residents, Oakland Tech High School and U. C. Berkeley classmates Marshawn Lynch, Leon Powe and Josh Johnson.
We have some very exciting, great footage with sponsors’ banners proudly and prominently displayed as there was local media coverage throughout the day and a television crew that filmed the entire event for a special broadcast! The real value here is there are PRICELESS shots of the kids walking, running and playing while eating sponsors food, bread and pastries!!! There are several public “Thank You’s” announced during the celebration as well.
We also have more footage taken from other community events that we were involved with that display sponsor banners as well. We did Marshawn Lynch’s “Fam1ly F1rst” Football Camp July 9, 2011 and will do Leon Powe’s “Fresh Start Oakland’s Powe Folk’s Basketball Camp” August 19-21, 2011 at Merritt College in Oakland. Both these two day camps which hosts over 600 youth, are an integral part of a continuing effort to reach and offer alternatives to the under served youth of color in the Oakland- Northern California region to combat some of the maladies that afflict and compromise these youth.
    As an example of this need, the North Oakland Gang Injunction that was recently passed at the behest of ousted former Oakland City Attorney John Russo is a “civil” lawsuit that imposes criminal restrictions on uncharged, unnamed, unknown youth of color whom only alleged “future” crime would be that they live in a certain area of Oakland. If this gang injunction were in place when Marshawn, Leon and Josh were kids, they would be classified as “Gang Members” today just because they live in a certain neighborhood and “know” each other. This “criminal activity” of living in a certain area is intolerable.
All this establishes a corporate presence in the community that evolves organically and spontaneously, that they could not buy! This is a great PR opportunity that they really considered in their Corporate Community Service and Marketing/Promotional efforts. We utilize these banners at other events we support to put something together special for them that will knock their socks off, that will be national in scope and penetration. They will have to approve the use of anything that capture the corporate banners in or create from using the images.

The recent Oakland Gang Injunction passed because City Attorney John Russo had the support of the ACLU whom has mobilized organizers to support, not fight it, to the peril of this North Oakland Community!
It has been established through research that this is nothing but another tool for developers to continue exercising gentrification of the Black Community unopposed because of the apathy and lack of leadership in defending the rights of the uncharged and unknown youth! Where is the National Action Network, NAACP, CORE, Rainbow Coalition, or any other national group that alleges to stand for Civil Rights when these youth are being trapped and “Okey Doaked” by the defenders of the public trust?
Every defendant “served”, and I use that term without any credibility under the legal process, with the unconstitutional injunction that has an attorney has been dropped from the matter! But those that were unrepresented were “convicted” in a civil proceeding with criminal implications because they do not have legal representation provided as in a criminal matter! If just one defaults, the system will entrap the rest of the youth population for ever.
Conveniently these liberal civil rights organizations will not represent theses people while filing an Amicus Brief yet venturing into the community with liberal organizers that will benefit from the demise of the youth punished by the injunction to advocate and pre-sell it’s inevitability and lobby for it’s acceptance as a needed measure to fight crime.
Forget about the “double jeopardy” that these youth face in a civil/criminal legal web cast by a deposed City Attorney whom has fabricated and planted that fabricated evidence in a case file, gave the case file to the defendants for nearly a year, and gave the case file to a judge for trial without notifying the court!
    A&MWF founder Abdul-Jalil al-Hakim has mobilized attorney’s to represent poor, under served youth and secured ALL-Americans, NFL All-Pro, NBA World Champions, North Oakland residents, Santa Fe Elementary, Oakland Tech High School and U. The Glenn Burke Story” on Monday, June 20 at 8 p.m. PT.  One-Hour Documentary to Be Broadcast Commercial-Free is nominated for a Northern California Area Emmy Award and a nominee for Outstanding Documentary at the 22nd Annual GLAAD (Gay & Lesbian Alliance Against Defamation) Media Awards, “Out. The Glenn Burke Story” documents Burke’s legacy as the first openly gay Major League Baseball player.  After the June 20 airing, “Out. The Glenn Burke Story” will re-air on Sunday, June 26 at 9 p.m. and Thursday, June 30 at 2:30 p.m.

Glenn Burke’s journey through baseball began and ended in Oakland, California. His sports career had many stops along the way, starting as a multi-sport star at Berkeley High School, followed by a brief stint at the University of Nevada, Reno as a prized basketball recruit, and then moving into professional baseball with the Los Angeles Dodgers, being hailed by one coach as “the next Willie Mays.”
Early in his career, Burke felt he had to hide his true self from his teammates.  Later, when he began to reveal glimpses into his sexuality the baseball establishment began to close him out.  Out. The Glenn Burke Story, a one-hour documentary produced by Comcast SportsNet Bay Area, tells the dramatic tale of Burke’s legacy as the first openly homosexual Major League Baseball player.  From his Major League debut in 1976 and starting Game One of the 1977 World Series for the Dodgers to subsequently being traded to the Oakland Athletics the next season, and then walking away in 1980 from the game that he deeply loved, Comcast SportsNet follows one of baseball’s most dramatic arcs.
Many of Burke’s teammates were aware of his homosexuality during his playing career, as were members of management. And many of those teammates believe that his sexuality – and the reaction it provoked – led to the premature derailment of his baseball career.
Out. The Glenn Burke Story tells the tumultuous story of the wedge that was driven between Burke and the Los Angeles management, the ensuing similar situation in Oakland that led to Burke’s abrupt retirement, and the hero’s welcome that Burke received in San Francisco’s Castro District after he left professional baseball.
Comcast SportsNet’s narrative follows Burke through his public announcement of his homosexuality in a 1982 Inside Sports magazine article (‘The Double Life of a Gay Dodger’) and on The Today Show with Bryant Gumbel, to his subsequent downward spiral to drugs, prison, and eventually living on the same San Francisco streets where he was once hailed as an icon.

Burke’s story took on another level of tragedy when he was diagnosed with AIDS in 1994.  Yet at the end of his life, the game that he claimed abandoned him so many years before reached out to one of its own. The A’s found Burke and provided him with constant support in his final months, as did some of his former teammates.
Glenn Burke passed away on May 30, 1995 at the age of 42 of AIDS-related complications.
Out. The Glenn Burke Story documents the extent of Burke’s courage, strife and friendship throughout his life, and the compassion and callousness of the sport of baseball.  The program weaves together insights from Burke’s teammates and friends, including Dusty Baker, Davey Lopes, Sports Agent Abdul-Jalil, Reggie Smith, Rick Monday, Manny Mota, Rickey Henderson, Claudell Washington, Mike Norris, Shooty Babitt, Tito Fuentes, and former Major Leaguer and gay rights activist Billy Bean. Pop Matters.com – ‘Out. The Glenn Burke Story’: That Macho Thing

“You were concerned of being stereotyped or typecast, that to know him must mean that you’re one. So you kept your distance.” A former Dodgers outfielder and coach, Reggie Smith remembers Glenn Burke as a player and friend. But still, he “kept his distance,” as Smith puts it, because Burke was out.
Smith’s concern was typical during the 1970s, when Burke played for the Dodgers, a time recounted in Out. The Glenn Burke Story. The documentary, produced by Doug Harris and Sean Madison, re-airs 1 December on Comcast SportsNet Bay Area, and is available as well on DirecTV’s sports pack channel 696 and Dish Network’s multi-sports package channel 419. It tells a story that is remarkable for a number of reasons, not least being Burke’s courage and determination: to this day, he remains the only Major League Baseball player to come out during his professional career.
The only one.
Out makes clear that Burke’s decision to come out was costly: as teammates struggled with their own feelings (Smith: “At that time, we were a little homophobic about people that were gay”), management was less ambivalent. The Dodgers dealt him to the As in 1977, where manager Billy Martin notoriously called him a “faggot” in front of his teammates. That same year, the A’s sent him down to the minors. Burke retired then, at age 27, despite good stats and an unfinished career.
As the film remembers, Burke didn’t talk about the trade or his retirement until 1982, in an interview with Inside Sports magazine (“The Double Life of a Gay Dodger”) and then an interview with Bryant Gumble on Today. The film includes a clip, with Gumble asking, “Were you traded from the Dodgers to the A’s because you were gay?” Burke shifts in his seat, tries not to answer, and then, prodded again (“What do you think?”), he nods, “Yeah.”
Out is compelling not only because of Burke’s story, but also because it is still such a difficult story to tell. The images of Burke, once a basketball and baseball star at Berkeley High School, are culled from archival game footage and stills (as well as headlines and baseball cards), and the narrative is structured mostly through new interviews with former teammates, associates, and Burke’s sisters. Repeatedly, the film offers nearly abstract shots of fences, the camera panning low or peering through chain-link obstructions. Sometimes the fences show blurred traffic behind them, sometimes road signs or baseball facilities, and sometimes they’re adorned with a photo of Burke, flapping in a breeze. Always, the fences serve as poignant, ominous emblems of his experience, ever outside.
The scanty information on his post-MLB life isn’t helped by the fact that Burke died of AIDS at 42, following a broken leg (when he was hit by a car in the Castro), drug use, jail time, and homelessness. And, if the film doesn’t narrate the point specifically, it does reveal in interviews the raced split in his life: the majority of his MLB teammates here are black, while his post-professional associates, say, softball teammates he met in San Francisco, are white.
The film’s visual structure—rudimentary, sometimes awkward—is likely dictated by a lack of available images. But it also makes a compelling point regarding the agonizing, persistent invisibility of gay athletes in the MLB (and the NFL and the NBA: in each professional league, players only come out after they’ve retired). How is it, the film asks implicitly, that homophobia can remain so standard in 2010?
Explanations are familiar. In the ‘70s, Oakland A’s right fielder Claudell Washington says, “Being ballplayers, we all had that macho thing going on.” Dusty Baker notes that he considered Burke a friend, but recalls, “Some of the guys on the team, especially some of the Latin guys, would act funny in the shower.” Pondering Burke’s fate in 1977, Davy Lopes observes, “If everybody knows the story, I think, there were other reasons why he was traded.” Smith adds, “I certainly didn’t want to accuse him of that, because one thing’s for sure, at that time period, it was a kiss of death for a ballplayer. He would’ve been excused from the game, so to say.”
So to say. Such lack of language shapes Out. Interview subjects share stories of their suspicions or their sympathies, mostly by innuendo: Washington remembers, “Glenn had some guys picking him up in pink Cadillacs” and Oakland Athletics infielder Shooty Babitt reports, “He had a red jock.” Smith says he wondered when he heard Burke “cooing” on a phone call with a man (“I didn’t know if this person had put a woman on the phone, I didn’t know what was going on”). Not everyone is so elusive.
Abdul-Jalil al-Hakim remembers a story Burke told in his autobiography, Out at Home: The Glenn Burke Story, when Dodgers management offered him $75,000 to get married. The story is that Burke responded with a question: “I guess you mean to a woman.” Jalil adds, “Glenn took exception to that, refused to do it, and openly dated Tommy Lasorda’s son.” 
It’s a funny story, and telling. As the film goes on to underscore Lasorda’s terrible homophobia (he insisted even after his son Spunky’s death that he was not gay), it also marks this moment of resistance as a point of no return for Burke. He lost his job and a certain, important sense of achievement, even as he found another sort of community in San Francisco. Billy Bean, an MLB player who came out after he retired, in 1999 (and is the only other player to be out at all), notes the fear that defines “male team sports.” He also makes clear the price Burke paid. “The closet hurts people forever,” Bean says now. Being forced to leave the game “because you don’t feel like you belong there when you’ve proven that you do, is damaging. And it affects everything.”
As U.S. official bodies rethink Don’t Ask Don’t Tell and gay marriage, individual bodies, bodies living real lives, are still feeling the effects of oppression, prejudice, and fear. Glenn Burke’s story helps to expose those effects.

The professional life of a general manager of a regional sports channel is likely a quiet one, bordering on being nondescript. Basically, you welcome in programming that is already made available to you through corporate means, like games or infomercials or syndicated shows. Or you hire reporters and producers to air about three or so hours of daily news. Nothing exciting to see or do there.
And then, there are execs like Ted Griggs, the vice president and general manager of Comcast SportsNet Bay Area. Griggs, who runs the San Francisco Bay Area channel, gave the green light to a superb documentary, “Out: The Glenn Burke Story,” that airs on the channel Thursday at midnight ET (or 9 p.m. Wednesday PT).
“Out” chronicles the life of Burke, who played for the Dodgers and the A’s in the late 1970s and early 1980s. Burke is presumed to be the first openly gay Major League Baseball player, and the hour-long film deals with Burke’s struggles in aching and painstaking detail, with haunting interviews from noted former teammates like Dusty Baker, Reggie Smith, Davey Lopes and Claudell Washington.
Filmmakers Doug Harris and Sean Maddison, both Bay Area natives, brilliantly use the words of Burke’s friends and family, as well as snippets of interviews with Burke conducted a year before his 1995 death of complications from AIDS, to tell his story. Included in the piece is a segment of his groundbreaking talk with then-Today Show anchor Bryant Gumbel, who interviewed the outfielder after Burke revealed his status in a 1982 story in the now-defunct Inside Sports magazine.
To the lasting credit of Griggs, Harris and Maddison, Burke is portrayed sympathetically, but not as a martyr; a subtle distinction, to be sure, but an important one, and one that raises “Out” from the status of a talking-head movie to an Emmy-quality film worthy of national distribution on Comcast’s outlets.
As it is, viewers outside Northern California can find Comcast SportsNet Bay Area on Direct TV at channel 696 and on Dish Network at channel 419. On Oakland Athletics manager Billy Martin introducing Burke to his new teammates in spring training:  “He was introducing all the players and then he got to Glenn and said, ‘Oh, by the way, this is Glenn Burke and he’s a faggot.’”
Davey Lopes:
On Burke’s trade to the A’s:  “You don’t break up, disrupt a team going as well as it was going to make changes.  I didn’t feel it was going to make us a better ball club.  Billy North was not going to make us, at that time, any better of a ballclub.  Probably not the real reason why things happened.”

Out.  The Glenn Burke Story is narrated by Morey, who was recently inducted into the Bay Area Radio Hall of Fame in the class of 2010 after 26 years as a morning host at KFOG and nearly 40 years in broadcasting.
Comcast SportsNet Bay Area will host a public screening of Out. The Glenn Burke Story at the Castro Theatre (429 Castro Street, San Francisco, California) on Wednesday, November 10. Doors open at 6:30 p.m. PT.  Admission is $5.00, with proceeds benefiting Marty’s Place.  Marty’s Place once provided a homeless Burke with shelter and care as he coped with the effects of AIDS/HIV.  Tickets are available at CSNBayArea.com/pages/out.  Following the screening, the network will air a special town-hall edition of Chronicle Live from the Castro Theater at approximately 9:15 p.m. PT.  Hosted by veteran Bay Area sports announcer Greg Papa, Chronicle Live is a live one-hour program, and will feature an interactive roundtable

November 16, 1952 Glenn Lawrence Burke is born in Oakland, California.
 
1970 In his senior year, Burke is named Northern California’s High School Basketball Player of the Year after leading the Berkeley High School Yellowjackets to a 32-0 record and winning the Tournament of Champions.
 
1971 Burke attends Merritt College in Oakland where he plays baseball and basketball, eventually earning a scholarship to the University of Nevada, Reno. 
 
June 6, 1972 Burke is drafted by the Los Angeles Dodgers in the 17th round of the 1972 amateur draft.
 
1972 Burke makes his professional debut for the Ogden Dodgers of the Rookie level Pioneer League.
 
1972 Burke is promoted to Low-A ball and plays 41 games for the Spokane Indians of the Northwest League.
 
1973 Burke hits .298, splitting time between Dodgers Single-A affiliates Daytona Beach and Bakersfield.
 
1974 Burke becomes the University of Nevada, Reno’s starting point guard during the preseason.  He scores 22 points against USC in a preseason game, but an early season injury convinces him to hang up his sneakers and focus on baseball.
 
1974 In his best season in the minors, Burke is hitting .338 at Single-A Bakersfield when he is promoted to AA Waterbury of the Eastern League.
 
April 9, 1976 Burke makes his major league debut with the Los Angeles Dodgers against the San Francisco Giants. 
 
1977 According to Burke’s autobiography, Dodgers general manager Al Campanis offers to pay for a lavish honeymoon if Burke agrees to get married.  Burke angrily refuses, seeing the offer as a way to cover up his homosexuality. 
 
October 2, 1977  Dodgers teammate Dusty Baker hits his 30th home run of the season and is greeted at home plate by Burke whose hand is raised in the air.  Baker does the same, and they slapped hands producing the first “High Five” in sports history.
 
October 11, 1977 Burke starts Game One of the 1977 World Series against the New York Yankees. 
 
 
May 17, 1978  The Dodgers trade Burke to the Oakland Athletics in exchange for outfielder Billy North.
 
June 4, 1979 Burke plays in his last major league game and then makes an abrupt mid-season departure from the A’s that leads to his eventual retirement.
 
1980 Burke comes out of retirement and reports to A’s spring training.
 
1980  At the young age of 27, Burke permanently retires from professional baseball due to personal differences with the A’s management.

October 1982 Burke becomes the first openly gay Major League baseball player by publically acknowledging his homosexuality in an Inside Sports magazine article entitled “The Double Life of a Dodger.” 
 
  Burke is a guest on NBC’s The Today Show and discusses the Inside Sports article with anchor Bryant Gumbel.
 
August 28, 1982  San Francisco hosts the inaugural Gay Games. Burke participates and earns gold medals, in track in the 100 and 220 meter sprints and as a member of both the men’s basketball and softball teams. 
 
January 27, 1983 NBC’s “Cheers” airs the episode “Boys in the Bar,” in which Sam Malone (played by Ted Danson) supports a former teammate who publicly acknowledges his homosexuality.  The show is based on Burke’s announcement the previous year.
 
1986  Burke competes in Gay Games 2 on the men’s basketball team.
 
1987  Burke is hospitalized after being hit by a car in San Francisco, breaking his leg in four places. 
 
1988  Burke is arrested for drug possession and briefly jailed.
    
1991  Burke pleads guilty to grand theft and possession of a controlled substance and serves six months in San Quentin penitentiary. 
 
1994  After a series of medical complications, Burke is diagnosed with AIDS. 
 
November 18, 1994 Berkeley Mayor Shirley Dean presents Burke’s family with a plaque and proclaims the first “Official Glenn Burke Day.”
 
May 30, 1995 Glenn Burke, 42, passes away in San Leandro, California due to AIDS-related complications.
 
July 1995 Burke’s autobiography “Out at Home, The Glenn Burke Story” is published and released.

Growing up in the East Oak Lane section of Philadelphia, Vivian Green’s musical talents emerged early in life. After receiving early training as a classical pianist and vocalist, she gained invaluable experience performing in jazz clubs, weddings and corporate functions. By covering songs by Celine Dion, Barbra Streisand, Whitney Houston, Chaka Khan, Donna Summer, and Aretha Franklin, among others, Vivian strengthened her vocal range. She recorded demos of her own compositions through her teen years, and received her first professional songwriting credit when Boyz II Men recorded her “Dear God” on their platinum-selling album Evolution.

Vivian’s increasing notoriety helped to win her a record deal with Sony Music, which released her debut album A Love Story in 2002. That disc spawned the urban AC/dance hits “Emotional Rollercoaster” and “Fanatic,” and established Vivian as one of the year’s most celebrated new artists. After a three-year recording hiatus, during which she gave birth to a son, she broke new musical ground on her second album Vivian, which produced the number one AC/dance singles “Gotta Go, Gotta Leave” and “I Like it But I Don’t Need It.” Vivian won rave reviews in such outlets as People, Rolling Stone and The New York Times, which described the album as “a stellar sophomore accomplishment.” Touring to support her first two albums, Vivian won a reputation as a riveting live performer, sharing stages with such artists as Maxwell, Teena Marie, Betty Wright, Chaka Khan, Betty Wright, Q-Tip, Anthony Hamilton, and Common.

In 2003, Vivian made her film debut, portraying Billie Holiday and performing the Holiday classic “Love for Sale” in the Oscar-nominated Cole Porter biopic De-Lovely. Two years later, she appeared in the TV series American Dreams, playing the role of Brenda Holloway and singing Holloway’s Motown hit “Every Little But Hurts.” Vivian wrote the music for David E. Talbert’s popular all-star stage play Love in the Nick of Tyme, which debuted in 2007. Also in 2007, she guested on Guru’s album Jazzmatazz Vol. 4 and Cyndi Lauper’s The Body Acoustic.

Vivian Green’s varied musical and personal experiences are reflected in the personally charged, effortlessly soulful music she makes on Beautiful. “As we get older,” she notes, “we get wiser and stronger and more secure in who we are. Released in late summer 2009, Music Fan First debuted at #5 on the ITunes R&B/Soul Charts, entered the Billboard Hot R&B/Hip-Hop Songs chart at #91 for the song “Borrow You”, and at #84 on the Top R&B/Hip-Hop Albums chart for the album. And most deservingly, the song “A Tale of Two” off of Music Fan First has been nominated for a 2010 Grammy Award for Best Urban/Alternative Performance, an amazing accomplishment for an Independent artist.

Born January 27, 1930, Rosemark, Tennessee. Moved to Memphis 1948. Played with Billy ‘Red’ Love and other influential Delta musicians. First recording was Dry Up Baby (Modern 848). Entered Armed Services 1952, joined Johnny Ace Revue after discharge, having signed with Duke Records. First smash hit, It’s My Life Baby, 1955 followed by years of consistent success in R&B market.
In the 50s and early 60s, Bobby “Blue” Bland was one of the main creators of the modern soul-blues sound. Along with such artists as Sam Cooke, Ray Charles, and Junior Parker, Bland developed a sound that mixed gospel with blues and R&B. Bobby’s style of soul-blues was punctuated with a big-band sound and slick, B.B. King-flavored guitar riffs.
Bland was born and raised in Rosemark, a small town just outside Memphis. In 1947 he moved to the city with his mother and began his career, first as a singer in the gospel group the Miniatures, then in the loosely knit blues group the Beale Streeters, which included such future blues stars as Johnny Ace, B.B. King, Junior Parker, and Rosco Gordon .
Bland’s first recordings were from 1950 to 1952, when he cut sides for the Modern and Chess labels. Being drafted into the army in 1952 put his career on hold, but shortly after his discharge in 1954, he began a long-term relationship with Duke Records. This would result in dozens of records, many of them big sellers in the R&B market.
Bobby’s first Duke single, “It’s My Life, Baby,” was released in 1955. Two years later, he scored with the seminal Texas shuffle “Farther Up The Road” (115 k, 10 sec.), which went to number 1 on the R&B charts. Follow-up records included two 1961 hits, “I Pity the Fool,” which also made it to number 1 on the R&B charts, and “Turn on Your Love Light,” which went to number 2. “That’s the Way Love Is,” a 1963 release, gave Bland his third number 1 hit.
From 1957 to 1961 Bland played the chitlin’ circuit with Junior Parker and his band, the Blue Flames. But in 1961 Bland broke with Parker, went out on his own, and rose to his greatest popularity. Because Bland neither composed nor played an instrument, he relied on others for songs and inspired instrumentation. Joe Scott, his bandleader and arranger, and for years one of Duke label owner Don Robey’s chief talent scouts, helped create Bland’s big-band sound. Just as important to Bland’s sound was guitarist Wayne Bennett, who complemented the horns and Bland’s vocals with jazz-influenced solos,a la T-Bone Walker and B.B. King.
Bland worked with Scott and Bennett until 1968 when the band broke up, partially the result of Bland’s alleged alcohol problems. But Bland resuscitated his career in 1972, this time with producer Steve Garrie and bandleader Ernie Fields, Jr. Rather than dwell on R&B ballads, Garrie gave Bland a blues-based sound that resulted in two of his more commercially successful albums: California Album (1973) and Dreamer (1974). Both works were released on the ABC-Dunhill label, the company that purchased Duke in 1972.
Despite Bland’s extensive recording catalogue, his long-term success on the R&B charts, and his near-constant touring (often with longtime friend B.B. King), he rarely crossed over into the pop realm. Dozens of blues and R&B influenced rock vocalists, however, have credited Bland as a main influence. Throughout the 70s, 80s, and early 90s, he continued to record, mostly for the Jackson, Mississippi, blues label, Malaco. Bland was inducted into the Blues Foundation’s Hall of Fame in 1981 and the Rock & Roll Hall of Fame in 1992. He continues to perform regularly.

Rapper, DJ, and producer Pete Rock first emerged in 1991 as one half of a duo with C.L. Smooth, debuting with the All Souled Out EP. A hit LP, Mecca and the Soul Brother, followed before the two went their separate ways in the wake of 1994’s The Main Ingredient, with Rock remaining a prolific studio presence prior to the release of his solo debut, Soul Survivor, on Loud/RCA four years later. Dropped from the label, he continued his career as an independent producer, and later signed to Rapster/BBE in 2001 for PeteStrumentals. Two years later, the label released a two-part compilation of mid-’90s LPs with Lost and Found. In 2004, Rock produced the sequel to his debut, Soul Survivor II, with features coming from Pharoahe Monch, Dead Prez, Talib Kweli, and former partner C.L. Smooth. OAKLAND CITY ATTORNEY JOHN RUSSO’S PROPOSED GANG INJUNCTION IS DECEPTIVE AND WRONG

Oakland City Attorney John Russo in his recent plea to implement a Gang Injunction in Oakland’s Fruitvale District hastily used the recent criminal charge of Attempted Residential Robbery upon Fruitvale resident and named Gang Injunction defendant Anthony Garcia.  In their latest arguments in support of why Oakland needs another Gang Injunction,  Garcia’s arrest was used to help sway Judge Robert Freedman to grant their requested relief. Turns out Garcia’s arrest and the resulting charge were frivolous. Prosecutors learned the statement given by Garcia’s neighbor to police was fraudulent; the neighbor said he had no idea what he was signing onto. Whether limited English or police coercion lies at the crux of the matter, the complaint given to police was recanted and charges were dropped. Not so fast, a serious charge, remains on Garcia’s record. With overzealous police and prosecutorial error at work against Garcia and others, can Judge Freedman honestly decide in favor of granting outgoing Oakland City Attorney John Russo another injunction? More to come on Freedman and why his court was likely selected by Russo. The San Francisco Chronicle’s Henry Lee reported the error in the Sunday paper, 5-15-11.

While a conviction is a more serious mark on one’s record than a recanted charge, a charge can sometimes be just as damning. It is all some potential employers rely upon to differentiate when hiring prospective employees. This mistake is not uncommon but apologies are most rare. A District Attorney should normally rely upon Probable Cause in deciding whether to file charges against an alleged criminal but is protected with immunity when a mistake is made. Never mind the six weeks Garcia spent in jail behind this frivolous arrest.  A criminal record could prevent Garcia, 29 from certain employment opportunities for the rest of his working adult life. He now has the daunting task of trying to recapture some semblance of normalcy in his life. Just ask Osha Neumann of the East Bay Community Law Center in Berkeley about the ongoing need for a “Clean Slate” program. His organization is consistently serving individuals who want to move on in their lives and yet because of criminal records cannot seem to do so otherwise.

At the heart of a Gang Injunction is usually an overreaching District Attorney and unfettered police power determined to gentrify a targeted area. At first blush what would appear an efficient crime fighting tool to clean streets and rid our communities of gang activity deceptively paves the way for real estate developers to curry favor with bankers to invigorate a sluggish housing market. This reality proves all too costly as Anthony Garcia’s rights are trampled upon. Contemplate the future untold costs of this stain on his record. In her best selling book, “The New Jim Crow,” author and attorney Michelle Alexander outlines the inability of former convicts to ever regain full citizenship. With criminal records in tow, an ex-con is unduly prevented from regaining full citizenship which includes voting in most states. The U.S. Constitution and the tenet that one can pay their debt to society and receive full re-integration is now a myth.

States bear a costly burden in creating a permanent underclass of fringe citizens.  To illustrate, in California a bill is currently before the legislature that aims to reduce our inmate population by granting medical parole to inmates who no longer pose a threat to society. If this bill passes, our state will save millions. It is simple, inmates with severe medical issues and the attendant costs to care and police them could be eligible for medical parole. However, tough on crime advocates want all prisoners to rot in prison no matter how high the price.Kudos to Mark Leno for introducing this bill because this model is so last century and is not working.   However, the Smart on Crime policy Attorney General Kamala Harris propagates is the better approach because it is too easy to throw the baby out with the bath water. We cannot expect different results using the same failed policies. Gang Injunctions have been tried in numerous jurisdictions only to fail. As Oakland fights rising crime, a sluggish real estate market and too few jobs or opportunities for its youth, Gang Injunctions are a waste of scarce taxpayer dollars that could be put to better use. To be sure Gang Injunctions are a sure way ameliorate problems on the surface but leave untold consequences. Just ask Garcia and the other named defendants who will not find it easy to recover.

In this unfortunate marriage between the Oakland Police Department, District Attorney and the Oakland City Attorney, which entity will attempt to remedy this huge transgression upon Garcia or the public trust? Most agencies will not admit mistakes even when made public. As Garcia picks up the pieces of his life, a public apology is in order but waiting for public officials to do the right thing is quite another matter. Time might be better spent questioning the many Affidavits signed by OPD officers as part of the  City Attorney’s case for the Gang Injunctions. Oakland could learn something from it’s neighbor across the bay. In San Francisco dozens of criminal convictions were recently overturned after the alert San Francisco Public Defender Jeff Adachi discovered the faulty procedures used in crime laboratories to gain illegal convictions.

A conviction much like a Gang Injunction, is only as legal as the foundation upon which it rests. Some Oakland Police Officers are not strangers to lies, innuendos or deceit; just check the many lawsuits that continue to be paid out to unfortunate victims at the hands of rouge cops. This is why the Affidavits signed by OPD officers should have been the first place Garcia’s defense attorney Siegel should have looked when preparing his defense. Who is Siegel and why is he representing Garcia and others to their peril? Early on Siegel admitted that he made a mistake causing over fifty defendants to lose representation. Though a procedural error, all it takes for an Injunction to be granted is the conviction of one defendant. When KPFA radio broadcaster and producer Nadra Foster was beaten by twelve or so Berkeley Police Officers a couple of years ago, it was Siegel’s father, Dan Siegel also an attorney and KPFA station board member who lauded KPFA management for calling the police on her while her daughters looked on. She was told to leave the building and did not understand the reason for the request. She is still suffering injuries as a result of the severe beating. Siegel appears to have overlooked pages of Affidavits signed by several OPD officers, many of which live outside of Oakland, swear that these named defendants are gang members who committed crimes, that they are menaces to society and they should be punished. Curious to note however, the Affidavits themselves are repetitive – cut and pasted text with recycled facts according to Oakland Police Officer Frank Morrow who refused to sign on when presented with one. The entire process is flawed as ever which is probably why a Federal Judge called a meeting with Police Administration and the City of Oakland in April 2011 to force the terms of the settlement intended to clean up that department that followed the infamous “Riders” scandal and trial.

As Oakland City Attorney John Russo leaves Oakland for Alameda with two Gang Injunctions possibly three under his belt and a couple of minority owned businesses he was instrumental in closing, he is poised to develop the Alameda Naval Air Base. The three Alameda City Council Members who elected Russo after he campaigned and donated money to help get them elected have their work cut out in trying to diminish their direct conflicts of interest. Alamedans should have taken cues from the corrupt Southern California town of Belle and its City Manger, Robert Rizzo who was charged with taking 5.5 million from working class residents.  The small minority owned business in Oakland and Alameda shut down by incoming Alameda City Manager John Russo that used to help people prepare legal documents now runs a food donation program that provides free food to the hungry.

As for Oakland, the fate of the Fruitvale District and its proposed Gang Injunction now rests with Judge Robert Freedman who is no stranger to controversy. Once subject to disbarment by the Judicial Council of California, the Administrative Agency charged with holding judges honest was once cited for filing false Affidavits and received probation. Apparently this was not enough to place him on the fringes of society but what of Garcia and the North Oakland residents and all the others subject to the whims of society’s current displeasure of disposable immigrants and people of color in general? If Garcia is to be considered more than a pawn for real estate developers; his case is a clarion call for the masses to wake up.

Gang Injunctions are part of a larger dilemma; class warfare, immigration, equal protection of the laws, civil rights and the tolling that unfettered police power and gentrification has upon society. An Oakland City Council meeting is scheduled for May 17, 2011 [May 17 marks the anniversary of the landmark Civil Rights victory that ended U.S. Apartheid, Brown v Board of Education] which could heavily influence the outcome of the next court hearing, scheduled for May 24, 2011.

    The leak of information on Oakland City Attorney John Russo’s extrinsic fraud, subornation of perjurious testimony and solicitation of perjurious testimony in witness affidavits for the Oakland Gang Injunction litigation is turning into a flood as there appears to be truth in the allegation. It has been rumored that witnesses complained that the affidavits were prepared for their signature without their approval containing inaccurate information, misleading facts, and mis-characterizing statements that were maliciously, willfully and intentionally false. Witness could not change the affidavit and felt they were slighted and perhaps retaliated against when they complained about it. There were other complaints about Russo’s tactics in recent matters as well. 
    The crooked City Attorney was involved in fabricating and planted that fabricated evidence in the al-Hakim insurance case file, gave the case file to the defendants for nearly a year, and then gave the altered case file to a judge for trial without notifying the court!
Abdul-Jalil al-Hakim filed a complaint with Congresswoman Barbara Lee, State Assemblyman Sandre Swanson, Alameda County Supervisor Kieth Carson, Oakland California Mayor Ron Dellums, Oakland City Administrator Dan Lindheim, Oakland City Auditor Courtney Ruby, Oakland City Councilpersons Desley Brooks and Larry Reid’s offices against Oakland City Attorney John Russo, Mark Morodomi, Randy Hall, Janie Wong, Anita Hong, Sophia Li, Demetruis Shelton- current President of the National Bar Association, Elizabeth Allen, Erica Harrold, Michele Abney, Eliada Perez; former Oakland and current San Leandro City Attorney Jayne Williams; former Oakland City employee Pat Smith; Stephan Barber and others of the law firm Ropers, Majeski; Ronald J.     This comes on the heels of a very embarrassing, very public spat with new Oakland Mayor Jean Quan and Russo taking personally abusive verbal shots at each other with Russo scorning the mayor for what he called a risky legal relationship with another attorney and Quan firing back at Russo for releasing his legal advice to the media before discussing it with her.

    “The problem is that John Russo tends to attack by press release,” Quan said, and complained that he issued his letter while she was still in Washington, D.C., where she attended U.S. Conference of Mayors meetings and also met with White House officials.
    Quan said Russo had created a conflict of interest by releasing his advice to the media when he did. “As the City Attorney giving advice to the Mayor, he has the duty of confidentiality and the duty of loyalty to his client. He broke that confidentiality by his actions,” Quan said in a written statement. “This is exactly why the Mayor’s Office and the City Council Offices have considered seeking independent, outside counsel. The City Attorney is the City’s only attorney,” Russo wrote in the letter he released. 
    Quan denied sharing any confidential city information with an attorney and friend who has been advising her, saying City Attorney John Russo’s suggestion that she may be spilling secrets was “frankly, insulting.”
That claim is false according to him, as Russo did not bring his concerns to Quan privately before alerting the media — Russo argued in a letter he sent to Quan, other city leaders and local media that the city attorney is the mayor’s only permissible attorney, so any information Quan shares with anyone other than Russo and those in his office — is not protected and can be subpoenaed, threatening the city’s standing in a host of legal scenarios and taking on another attorney, especially one connected to a fight against the city, is breaking the City Charter and creates a conflict of interest. 
    “We have a city attorney who is elected and so sometimes has his own political agenda,” Quan said. 
“I’m caught in the middle, and I’m sorry about that.” 
    “This is a uniquely obnoxious violation of the charter because he’s in the middle of this,” Russo said. “I should be able to brief (Quan) on the strengths and weaknesses of our cases. If she’s going to turn around and give that to our opponents, how am I supposed to do my job?” “What the mayor has done here,” Russo added, “is put my office in a very awkward position where we’re not sure we can give confidential information to Mayor Quan. You should never be in that position with the CEO of the corporation.” “Violation of the City Charter is a crime,” Russo wrote in closing. “It is now incumbent on you to uphold your oath to defend the Charter.” 
    Quan, a longtime adversary of Russo from his days on the Council, feels concerned as the public see’s Russo has overstepped his boundary by pursuing the injunction without endorsement from the city council or the mayor in his continuing quest to be the De-Facto mayor. There is a question about what is the authority of the city attorney to bring these cases without the authorization of city council and the Mayor.”

There’s also a marijuana ordinance in front of city council that is endorsed by “Johnny Potty” Russo. He picked up that handle because of his penchant for doing video interviews in the restroom “potty” with another man, not to mention the weed endorsement. Does the citizens of Oakland really want a crooked City Attorney who drives around with his kids in the car without their seat belts on, wants to legalize smoking weed and gives video interviews in the bathroom with another man? The unfortunate part about this episode is Mayor Quan’s adviser has also been busted for marijuana so everything is up in smoke!
    A court hearing that could result in the implementation of the injunction is scheduled for February 16, 2011 before admitted and convicted liar, the embattled Judge Robert Freedman.

Judge Robert Freedman’s Misconduct Warranted His Removal from Office
    al-Hakim filed a formal complaint on April 11, 2008 and April 14, 2008 with both the Judicial Council and Superior Court against Judge Tigar for his attempt at provoking al-Hakim at a side bar during trial. al-Hakim received a one sentence response dated September 26, 2008 from Victoria Henley stating that “your submission does not provide a basis for commission proceedings”. al-Hakim received a letter dated April 15, 2008 from then Presiding Judge Yolanda Northridge acknowledging receipt of the complaint referring the matter to the Supervising Judge, Robert Freedman for review but has gotten no response as promised. 
    No one should be surprised because Judge Freedman has had his own well documented problems with honesty by willfully and intentionally filing false, perjurious and deceiving documents and affidavits regrading the timeliness in the administration of his duties in order to get paid and was issued a public reprimand. 
    In June 2007 The Commission on Judicial Performance publicly censured Alameda Superior Court Judge Robert J. Freedman for violating rules of conduct by failing to decide cases on time and falsely swearing that he was keeping up with time limits. 
Judge Freedman’s misconduct was of such gravity as to warrant his removal from office, the commission said, but the presence of mitigating evidence justified reducing the punishment to a “severe public censure.” You can read and/or download the article on Judge Freeman’s Censure at: http://www.box.net/shared/5n0tt72rbt
    The commission adopted factual findings made by a panel of special masters, who found by clear and convincing evidence that Freedman delayed rulings in 21 of the 23 cases over which he was charged in a notice of formal proceedings last May. 
It also agreed with the panel that Freedman, as accused in the notice, regularly signed and submitted false salary affidavits to the county during times when he was aware his rulings were overdue. He has a checkered past in al-Hakim’s case as well. 
    At one hearing in that matter he openly stated bias, prejudice, voiced a fixed opinion of al-Hakim and having an improper ex-parte communications regarding al-Hakim and his case while using such information to hold al-Hakim to a higher legal standard than that of the opposing counsel in the case as a guise for sanctioning al-Hakim for it. al-Hakimis convinced and Freedman’s three years of delay demonstrate that he will not seriously review nor is he capable of impartially or fairly judging this matter, even for review.

Russo’s Interest in Real Estate Firm
    Is there any truth to the allegation that Russo has an interest in a real estate firm? It is widely acknowledged that the Gang Injunctions are nothing but another tool for developers to continue exercising gentrification of the Black/Latino Communities unopposed because of the apathy and lack of leadership in defending their rights from the so-called leaders! Where are the national groups that alleges to stand for Civil Rights when the minority communities are being raped and “Okey Doaked” by the “white liberal” defenders of the public trust?

The Merits of The Gang Injunction
    The University of California, Berkeley – School of Law’s Center for Criminal Justice cites nationwide statistics that overwhelming prove Gang Injunctions are ineffective in all jurisdictions.
The following are but a few reasons cited by the legal community on why Russo’s proposed injunction should not be granted:
·        At a time when California’s budget is in a record crisis, does Oakland have resources to waste on an injunction that costs hundreds of thousands of dollars to enforce yet will not bring about positive crime reduction results?
·        The injunction would increase the distance between police and communities, does not focus on rehabilitation, reasons why youth join gangs, jobs or education which youth of our state so desperately need. Study after study has shown that rehabilitation is over ninety percent effective for this age group.
·        A federal judge who is monitoring Oakland police reforms heavily criticized the police department at a hearing and threatened to take it over, the Tribune reported. Judge Thelton Henderson, who is monitoring the OPD because of the Riders scandal, threatened to put the department in “receivership.” If that were to happen, the judge would appoint an overseer who would have power over Oakland Police Chief Anthony Batts. The judge is upset that the Oakland Police Department has still not instituted the police misconduct reforms that it agreed to several years ago. A Legal Settlement is a contract – breach of which by OPD opens the city up to even more money damages.
·        In light of the above, if Russo has his way, the police will undeservedly regain power; usurping Federal power, creating a “Fiefdom” for Russo. A failed police department does not deserve to continue down a path of destruction – that is why the Federal Government stepped in to begin with. If the Rider’s Settlement is not given effect – the entire trial was for naught -yet another waste of taxpayer dollars.
·        The named defendants in the injunction are guilty until proven innocent. This turns the US Constitution upside down. An injunction is simply not necessary because Police need only a reasonable suspicion to stop and frisk a suspect – not the higher level of probable cause. Reasonable suspicion and closer ties to the community is what is needed to bring about crime reduction and community building. An injunction is lazy police work; overkill – unnecessary and has a counter-effective result by tearing down the very community it is supposedly there to clean up.
·        The injunction will not result in safer streets but creates unfettered power in John Russo’s office. Further, an injunction opens the communities up to profit mongers such as real estate developers like John Russo’s family business owners. At a time when Oaklanders are losing their homes to foreclosure at record numbers, their interests rather than big business should be put first. 

 D. A. & Oakland City Attorney Fraud Victim Forcibly Removed from Courthouse Building Threatened With Arrest

    The following letter is from Alameda County District Attorney and Oakland City Attorney fraud victim Abdul-Jalil al-Hakim to an over 40 year personal friend and family client, the Honorable Judge Leo Dorado regarding an encounter with District Attorney henchman Bob Connor whom forcibly removed al-Hakim from the Rene Davidson Courthouse building and threatened to arrest al-Hakim if he ever returned.     al-Hakim also filed the complaint with Oakland City Auditor Courtney Rudy, long rumored to be Russo’s love interest, only to have her refuse to investigate  the complaint, though she is compelled to do so by the passing of Russo’s “Oakland ROAR” anti-corruption program. The program was alleged to revive the confidence of the citizens of Oakland in the City Administrators.     al-Hakim will petition President Obama and U. S. Dear Judge Dorado,

    First, let me say “Happy Holidays” to you and the family! I know that everyone must be doing great, and since the kids are not getting any younger, I guess you and I can not be 21 any longer! What’s this I hear about you having hip replacement and moving to Juvenile Court? We have some catching up to do, which was part of the reason I was coming to see you when I was removed from the courthouse building!

    I have awaited your response to our last conversation and the results of your inquiry into the District Attorney’s actions wherein hopefully we could meeting to discuss the above very serious concerns. 

    It is unfathomable that such a thing could happen in today’s highly charged racial, political, and law enforcement versus community interactive environment, especially in Oakland and Alameda County where deadly force seems to be the rule rather than the exception. We have also discussed my previous interaction with officer Bob Connor during my Oakland Police Burglary case which you are aware of and know that he is not someone I trust or would interact with in any manner. He clearly tried to put me in harms way where I could/would have been killed! I made it clear then that I never intended to speak or have any contact with him ever again in life.

    To allow the D. A.‘s office to handle me and my complaint in such a Gestapo fashion and to use you as a ruse is unacceptable, needs to be investigated, the responsible parties held accountable and punished. I have yet to receive any response from Nancy O’Malley.     Clearly something must be done as I have waited for you to get back to me to move this process forward. There is no circumstance or law that can justify this use of force, intimidation, and threat of imprisonment under the guise and color of law!. You know that I will not allow this continuing injustice to go on unnoticed so, what time is best for you since I want to meet as soon as possible! 

    We are all very busy, and especially this time of year, but I have been speaking to the D. A.’s office about this matter since June of this year with the above results. The matter of the fraud and corruption committed by the District Attorney and Oakland City Attorney and I are not going to magically disappear so let’s address it and move on. 

    I have litigation that was to be filed in November the day of my being forcibly removed from the court house and threatened with arrest if I returned. I was unable to complete that filing, wherein the D. A.’s office has compromised these suits and this issue also must be corrected ASAP!

    Please respond with a time ASAP and I will accommodate that time and it can be after working hours or the weekend, if it’s best for you. We have some catching up to do anyway.

    Thank you and I welcome and look forward to your immediate response with the furthering of the litigation and resolution of this ongoing case.

Oakland City Attorney Fraud, Solicitation Perjurious Testimony in Affidavits for Gang Injunction!

    The leak of information on Oakland City Attorney John Russo’s extrinsic fraud, subornation of perjurious testimony and solicitation of perjurious testimony in witness affidavits for the Oakland Gang Injunction litigation is turning into a flood as there appears to be truth in the allegation. It has been rumored that witnesses complained that the affidavits were prepared for their signature without their approval containing inaccurate information, misleading facts, and mis-characterizing statements that were maliciously, willfully and intentionally false. Witness could not change the affidavit and felt they were slighted and perhaps retaliated against when they complained about it. There were other complaints about Russo’s tactics in recent matters as well.
This comes on the heels of a very embarrassing, very public spat with new Oakland Mayor Jean Quan and Russo taking personally abusive verbal shots at each other with Russo scorning the mayor for what he called a risky legal relationship with another attorney and Quan firing back at Russo for releasing his legal advice to the media before discussing it with her.

“Russo Tends to Attack by Press Release” Oakland Mayor Jean Quan
    “The problem is that John Russo tends to attack by press release,” Quan said, and complained that he issued his letter while she was still in Washington, D.C., where she attended U.S. Conference of Mayors meetings and also met with White House officials.
Quan said Russo had created a conflict of interest by releasing his advice to the media when he did. “As the City Attorney giving advice to the Mayor, he has the duty of confidentiality and the duty of loyalty to his client. He broke that confidentiality by his actions,” Quan said in a written statement. “This is exactly why the Mayor’s Office and the City Council Offices have considered seeking independent, outside counsel. The City Attorney is the City’s only attorney,” Russo wrote in the letter he released.
Quan denied sharing any confidential city information with an attorney and friend who has been advising her, saying City Attorney John Russo’s suggestion that she may be spilling secrets was “frankly, insulting.”
That claim is false according to him, as
Russo did not bring his concerns to Quan privately before alerting the media — Russo argued in a letter he sent to Quan, other city leaders and local media that the city attorney is the mayor’s only permissible attorney, so any information Quan shares with anyone other than Russo and those in his office — is not protected and can be subpoenaed, threatening the city’s standing in a host of legal scenarios and taking on another attorney, especially one connected to a fight against the city, is breaking the City Charter and creates a conflict of interest.
“We have a city attorney who is elected and so sometimes has his own political agenda,” Quan said.
“I’m caught in the middle, and I’m sorry about that.”
“This is a uniquely obnoxious violation of the charter because he’s in the middle of this,” Russo said. “I should be able to brief (Quan) on the strengths and weaknesses of our cases. If she’s going to turn around and give that to our opponents, how am I supposed to do my job?” “What the mayor has done here,” Russo added, “is put my office in a very awkward position where we’re not sure we can give confidential information to Mayor Quan. You should never be in that position with the CEO of the corporation.” “Violation of the City Charter is a crime,” Russo wrote in closing. “It is now incumbent on you to uphold your oath to defend the Charter.”
Quan, a longtime adversary of Russo from his days on the Council, feels concerned as the public see’s Russo has overstepped his boundary by pursuing the injunction without endorsement from the city council or the mayor in his continuing quest to be the De-Facto mayor. There is a question about what is the authority of the city attorney to bring these cases without the authorization of city council and the Mayor.”

Oakland Marijuana Ordinance
There’s also a marijuana ordinance in front of city council that is endorsed by “Johnny Potty” Russo. He picked up that handle because of his penchant for doing video interviews in the restroom “potty” with another man, not to mention the weed endorsement. Does the citizens of Oakland really want a crooked City Attorney who drives around with his kids in the car without their seat belts on, wants to legalize smoking weed and gives video interviews in the bathroom with another man? The unfortunate part about this episode is Mayor Quan’s adviser has also been busted for marijuana so everything is up in smoke!
    A court hearing that could result in the implementation of the injunction is scheduled for February 16, 2011 before admitted and convicted liar, the embattled Judge Robert Freedman.

Judge Robert Freedman’s Misconduct Warranted His Removal from Office
    al-Hakim filed a formal complaint on April 11, 2008 and April 14, 2008 with both the Judicial Council and Superior Court against Judge Tigar for his attempt at provoking al-Hakim at a side bar during trial. al-Hakim received a one sentence response dated September 26, 2008 from Victoria Henley stating that “your submission does not provide a basis for commission proceedings”. al-Hakim received a letter dated April 15, 2008 from then Presiding Judge Yolanda Northridge acknowledging receipt of the complaint referring the matter to the Supervising Judge, Robert Freedman for review but has gotten no response as promised.
No one should be surprised because Judge Freedman has had his own well documented problems with honesty by willfully and intentionally filing false, perjurious and deceiving documents and affidavits regrading the timeliness in the administration of his duties in order to get paid and was issued a public reprimand.
In June 2007 The Commission on Judicial Performance publicly censured Alameda Superior Court
Judge Robert J. Freedman for violating rules of conduct by failing to decide cases on time and falsely swearing that he was keeping up with time limits.

The commission adopted factual findings made by a panel of special masters, who found by clear and convincing evidence that Freedman delayed rulings in 21 of the 23 cases over which he was charged in a notice of formal proceedings last May.
It also agreed with the panel that Freedman, as accused in the notice, regularly signed and submitted false salary affidavits to the county during times when he was aware his rulings were overdue. He has a checkered past in al-Hakim’s case as well.

al-Hakim and having an improper ex-parte communications regarding al-Hakim and his case while using such information to hold al-Hakim to a higher legal standard than that of the opposing counsel in the case as a guise for sanctioning al-Hakim for it. al-Hakim is convinced and Freedman’s three years of delay demonstrate that he will not seriously review nor is he capable of impartially or fairly judging this matter, even for review.

First, let me say “Happy Holidays” to you and the family! I know that everyone must be doing great, and since the kids are not getting any younger, I guess you and I can not be 21 any longer! What’s this I hear about you having hip replacement and moving to Juvenile Court? We have some catching up to do, which was part of the reason I was coming to see you when I was removed from the courthouse building!

I have awaited your response to our last conversation and the results of your inquiry into the District Attorney’s actions wherein hopefully we could meeting to discuss the above very serious concerns.

It is unfathomable that such a thing could happen in today’s highly charged racial, political, and law enforcement versus community interactive environment, especially in Oakland and Alameda County where deadly force seems to be the rule rather than the exception. We have also discussed my previous interaction with officer Bob Connor during my Oakland Police Burglary case which you are aware of and know that he is not someone I trust or would interact with in any manner. He clearly tried to put me in harms way where I could/would have been killed! I made it clear then that I never intended to speak or have any contact with him ever again in life.

To allow the D. A.‘s office to handle me and my complaint in such a Gestapo fashion and to use you as a ruse is unacceptable, needs to be investigated, the responsible parties held accountable and punished. I have yet to receive any response from Nancy O’Malley.     Clearly something must be done as I have waited for you to get back to me to move this process forward. There is no circumstance or law that can justify this use of force, intimidation, and threat of imprisonment under the guise and color of law!. You know that I will not allow this continuing injustice to go on unnoticed so, what time is best for you since I want to meet as soon as possible!

We are all very busy, and especially this time of year, but I have been speaking to the D. A.’s office about this matter since June of this year with the above results. The matter of the fraud and corruption committed by the District Attorney and Oakland City Attorney and I are not going to magically disappear so let’s address it and move on.

I have litigation that was to be filed in November the day of my being forcibly removed from the court house and threatened with arrest if I returned. I was unable to complete that filing, wherein the D. A.’s office has compromised these suits and this issue also must be corrected ASAP!

Please respond with a time ASAP and I will accommodate that time and it can be after working hours or the weekend, if it’s best for you. We have some catching up to do anyway.

Victim of D A Corruption, Fraud Forcibly Removed from Courthouse Building, Threatened with Arrest!!!

The following letter is from Alameda County District Attorney and Oakland City Attorney fraud victim Abdul-Jalil al-Hakim to an over 40 year personal friend and family client, the Honorable Judge Leo Dorado regarding an encounter with District Attorney henchman Bob Connor whom forcibly removed al-Hakim from the Rene Davidson Courthouse building and threatened to arrest al-Hakim if he ever returned. Connor is very well known to both parties.
al-Hakim has filed a formal complaint against the Alameda County District Attorney office and the City Attorney’s John Russo of Oakland and Jayne Williams of San Leandro and their City Attorney’s office administrations including the law firm of Meyers Nave, on June 7, 2010. After several conversations with the Alameda County District Attorney office, District Attorney Nancy O’Malley assigned the case to Assistant District Attorney Kevin Dunleavy. After his review and several more conversations with al-Hakim, Dunleavy decided to assign the case for investigation. al-Hakim will petition President Obama and U. S. Attorney General Eric Holder to expand the initial investigation of a complaint filed in 2005 by demanding a change in this criminal, tactical policy of isolation, victimization, criminalization and the attempted entrapment of the victim, including the use of government initiated, Nixon era “White House Plumbers” and CoIntelpro style dirty tricks! This civil conspiracy has brought into play County and Sate Agencies to further it’s continued investigation of al-Hakim whom the defense admitted in 1998 has been surveilled for years and continues today with the compromising of many agents and informants covers due to their sloppiness. These actions of Dunleavy, and Connor are just the latest example of the continuing efforts of law enforcement to silence and eliminate al-Hakim as their adversary when he has caught and exposed them as they have been entrapped in their own crimes!After the encounter with Connor, al-Hakim spoke with District Attorney Matt Golde and Dorado regarding his treatment and called O’Malley to voice his extreme concern wherein he received a return call from Dunleavy. Glenn Burke’s journey through baseball began and ended in Oakland, California. His sports career had many stops along the way, starting as a multi-sport star at Berkeley High School, followed by a brief stint at the University of Nevada, Reno as a prized basketball recruit, and then moving into professional baseball with the Los Angeles Dodgers, being hailed by one coach as “the next Willie Mays.”
Early in his career, Burke felt he had to hide his true self from his teammates.  Later, when he began to reveal glimpses into his sexuality the baseball establishment began to close him out.  Out. The Glenn Burke Story, a one-hour documentary produced by Comcast SportsNet Bay Area, tells the dramatic tale of Burke’s legacy as the first openly homosexual Major League Baseball player.  From his Major League debut in 1976 and starting Game One of the 1977 World Series for the Dodgers to subsequently being traded to the Oakland Athletics the next season, and then walking away in 1980 from the game that he deeply loved, Comcast SportsNet follows one of baseball’s most dramatic arcs.
Many of Burke’s teammates were aware of his homosexuality during his playing career, as were members of management. And many of those teammates believe that his sexuality – and the reaction it provoked – led to the premature derailment of his baseball career.
Out. The Glenn Burke Story tells the tumultuous story of the wedge that was driven between Burke and the Los Angeles management, the ensuing similar situation in Oakland that led to Burke’s abrupt retirement, and the hero’s welcome that Burke received in San Francisco’s Castro District after he left professional baseball.
Comcast SportsNet’s narrative follows Burke through his public announcement of his homosexuality in a 1982 Inside Sports magazine article (‘The Double Life of a Gay Dodger’) and on The Today Show with Bryant Gumbel, to his subsequent downward spiral to drugs, prison, and eventually living on the same San Francisco streets where he was once hailed as an icon.
Burke’s story took on another level of tragedy when he was diagnosed with AIDS in 1994.  Yet at the end of his life, the game that he claimed abandoned him so many years before reached out to one of its own. The A’s found Burke and provided him with constant support in his final months, as did some of his former teammates.
Glenn Burke passed away on May 30, 1995 at the age of 42 of AIDS-related complications.

On Burke’s homosexuality and the homophobia in Major League Baseball:  “It was uncompromising on both ends.  Glenn was comfortable with who he was. Baseball was not comfortable with who he was.”
Claudell Washington:
On Oakland Athletics manager Billy Martin introducing Burke to his new teammates in spring training:  “He was introducing all the players and then he got to Glenn and said, ‘Oh, by the way, this is Glenn Burke and he’s a faggot.’”
Davey Lopes:
On Burke’s trade to the A’s:  “You don’t break up, disrupt a team going as well as it was going to make changes.  I didn’t feel it was going to make us a better ball club.  Billy North was not going to make us, at that time, any better of a ballclub.  Probably not the real reason why things happened.”
Dusty Baker:
On the rumors of Burke’s sexual preference and his trade to the A’s:  “I think the Dodgers knew; I think that’s why they traded Glenn.”
Reggie Smith:
On the suspicions on Burke’s sexuality:  “I certainly didn’t want to accuse him of that, because one thing’s for sure – at that time period, it was a kiss of death for a ballplayer.  He would’ve been excused from the game, so to say.”

On Dodger management and their suspicions:  “Al Campanis and Walter O’Malley had called him into the office and offered him $75,000 to get married.  And Glenn, being his comic self, said, ‘I guess you mean to a woman?’”

On the reaction of Burke’s teammates the day he was traded:  “I was shocked that he was traded… I walked into the clubhouse…and guys were visibly distraught over the trade, and that told me that my sense of how important he was to them internally was accurate.  I even remember a few players crying when they found out about it at their lockers, which is stunning.”
Billy Bean:
On dealing with discrimination:  “The closet hurts people – forever.  Everyone’s career ends, but to do it because you don’t feel you belong there when you’ve proven that you do is damaging.  And it affects everything, and I’m sure that’s why Glenn swam in the waters of drugs and alcohol – to take away his frustration.”
Claudell Washington:
On hearing about Burke contracting AIDS:  “I was stunned at that time. A person that I’d known, loved, and respected had contracted an illness like that and was suffering.”

On AIDS:  “A lot of people were scared because I think, at the time, you didn’t know whether you can just breathe on somebody and get AIDS or just touch them.”
Pamela Pitts (Oakland A’s Director of Baseball Administration):
On Burke’s reaction to hearing the A’s would help him:  “Glenn started to cry and said, ‘I’ve been told you’re going to help me. I can’t believe someone wants to help me.’”
On Burke’s death: “I do believe he was in a much better place.  His demons were gone.”

Out.  The Glenn Burke Story is narrated by Morey, who was recently inducted into the Bay Area Radio Hall of Fame in the class of 2010 after 26 years as a morning host at KFOG and nearly 40 years in broadcasting.

Comcast SportsNet Bay Area will host a public screening of Out. The Glenn Burke Story at the Castro Theatre (429 Castro Street, San Francisco, California) on Wednesday, November 10. November 16, 1952 Glenn Lawrence Burke is born in Oakland, California.
1970 In his senior year, Burke is named Northern California’s High School Basketball Player of the Year after leading the Berkeley High School Yellowjackets to a 32-0 record and winning the Tournament of Champions.
1971 Burke attends Merritt College in Oakland where he plays baseball and basketball, eventually earning a scholarship to the University of Nevada, Reno.
June 6, 1972 Burke is drafted by the Los Angeles Dodgers in the 17th round of the 1972 amateur draft.
1972 Burke makes his professional debut for the Ogden Dodgers of the Rookie level Pioneer League.
1972 Burke is promoted to Low-A ball and plays 41 games for the Spokane Indians of the Northwest League.
1973 Burke hits .298, splitting time between Dodgers Single-A affiliates Daytona Beach and Bakersfield.
1974 Burke becomes the University of Nevada, Reno’s starting point guard during the preseason.  He scores 22 points against USC in a preseason game, but an early season injury convinces him to hang up his sneakers and focus on baseball.
1974 In his best season in the minors, Burke is hitting .338 at Single-A Bakersfield when he is promoted to AA Waterbury of the Eastern League.
April 9, 1976 Burke makes his major league debut with the Los Angeles Dodgers against the San Francisco Giants.
1977 According to Burke’s autobiography, Dodgers general manager Al Campanis offers to pay for a lavish honeymoon if Burke agrees to get married.  Burke angrily refuses, seeing the offer as a way to cover up his homosexuality.
October 2, 1977  Dodgers teammate Dusty Baker hits his 30th home run of the season and is greeted at home plate by Burke whose hand is raised in the air.  Baker does the same, and they slapped hands producing the first “High Five” in sports history.
October 11, 1977 Burke starts Game One of the 1977 World Series against the New York Yankees.
May 17, 1978  The Dodgers trade Burke to the Oakland Athletics in exchange for outfielder Billy North.
June 4, 1979 Burke plays in his last major league game and then makes an abrupt mid-season departure from the A’s that leads to his eventual retirement.
1980 Burke comes out of retirement and reports to A’s spring training.
1980  At the young age of 27, Burke permanently retires from professional baseball due to personal differences with the A’s management.
October 1982 Burke becomes the first openly gay Major League baseball player by publically acknowledging his homosexuality in an Inside Sports magazine article entitled “The Double Life of a Dodger.”
Burke is a guest on NBC’s The Today Show and discusses the Inside Sports article with anchor Bryant Gumbel.
August 28, 1982  San Francisco hosts the inaugural Gay Games. Burke participates and earns gold medals, in track in the 100 and 220 meter sprints and as a member of both the men’s basketball and softball teams.
January 27, 1983 NBC’s “Cheers” airs the episode “Boys in the Bar,” in which Sam Malone (played by Ted Danson) supports a former teammate who publicly acknowledges his homosexuality.  The show is based on Burke’s announcement the previous year.
1986  Burke competes in Gay Games 2 on the men’s basketball team.
1987  Burke is hospitalized after being hit by a car in San Francisco, breaking his leg in four places.
1988  Burke is arrested for drug possession and briefly jailed.
1991  Burke pleads guilty to grand theft and possession of a controlled substance and serves six months in San Quentin penitentiary.
1994  After a series of medical complications, Burke is diagnosed with AIDS.
November 18, 1994 Berkeley Mayor Shirley Dean presents Burke’s family with a plaque and proclaims the first “Official Glenn Burke Day.”
